Abstract

This chapter provides an example of a ‘bottom-up’ approach to philosophy which engages in detail with the cases themselves in order to work up to more general philosophical issues. Exploring in detail recent freedom of religion cases heard by the European Court of Human Rights, the chapter demonstrates the advantages of this way of doing philosophy that takes the legal material seriously, rather than constraining it within preestablished conceptual structures.
