Abstract

The problem of court delay has constantly been raised by local reformist discourses over the last decades. The judicial reforms those discourses promoted have ended up deeply modifying the legitimating principles of criminal justice. The present article analyses the historical development of those reformist discourses focusing on the paradigmatic case of the Province of Buenos Aires in Argentina. Firstly, the analysis seeks to point out how the objective of eradicating court delay has justified the need for a long series of judicial reforms. Secondly, it aims at identifying how those discourses and the reforms they promoted have progressively introduced the managerial rationality into the way criminal justice works. Lastly, the article analyses the consequences of the colonization of the criminal justice by the managerial discourse.
